The lens was in excellent condition but the buyer put in a return request 5 weeks after receiving the item claiming the lens was scratched and did not match the description or the lens in the photos which is rubbish. My feedback is 100% and I am a small seller with usually about 10 items for sale at any one time.

Seems Ebay did a back flip, buyer complained, Ebay refunded them, said I could appeal which I did and Ebay said they would get back to me in 48hrs, 2 hours later my appeal was declined. The buyer rented my lens for five weeks for free and receives 100% refund and the lens to boot.

They kept the lens too? That sounds quite unfair.

If the request was submitted after the item was no longer eligible for the MBG, and eBay still wants to refund the buyer, that refund should have come from their own pocket - if you are prepared to fight eBay on this point, particularly after they advised you of having no obligation to accept the return (I assume you have a copy of the chat transcript where they said this, too?), then I think you have a good chance of winning out in the end, but it may be a frustrating experience to get to that point.

Not sure these days with all the changes, but there is a possibility the buyer opens a dispute with PayPal.
