There is a scam that I have been burnt with and ebay is a part of.
We sold am item to the US from Australia, the purchaser paid surface shipping, (8 weeks), Australia Post doesn't offer tracking at this cost, buyer tells ebay hasn't been recieved, ebay givens them their money back and back charges you. I have proof of postage, reciept & photo of item after stamps etc affixed, but ebay didn't give a rats.
eaby customer service runs from scripts and when you say something not on the script, or prove them wrong, they ignore you.
SO BE AWARE DO NOT SHIP ANYTHIG WITHOUT TRACKING NUMBER, EVEN IF YOU LOSS THE SALE
EBAY DOES NOT CARE WHAT YOUR HISTORY IS, YOU ARE IN THE WRONG

Despite the advice and opinions given to you above... lots of which comes from very experienced and knowledgeable sellers by the way...
Nonetheless, if you still firmly believe you have been scammed by either your buyer or ebay complicity (or both) and you have strong evidence to back up your claims then I would encourage you to raise a formal complaint with The ACORN.
Present your case, including of course your evidence, and allow the Federal Police to investigate it.
Then inform ebay of the case reference number. They may even reverse their original decision if they can see you have strong evidence that could in some way make them complicit.
