I am an idiot and now i need help please

I sold 5 pieces of gold on ebay - customer was happy.

The other 5 pieces of gold turned in at auction. After auction i got an email offering me a set amout for the 5 gold. I agreed and he payed thru paypal.

I sent via a tracking number.

I get a message to say he received but one piece of gold is the wrong sizing in the box.

I ring the first guy who got the other gold and he looks and yes - he has a wrong size in a box.

So the first guy sends his incorrect piece of gold back to me.

I tell the second guy to send his wrong piece back and i will swap boxes and sent them to the rightful owner and i will compensate postage.

I have had a whole pile of abusive messages to my phone calling me a thief. I said i have done nothing dishonest it is human error. Return the one incorrect coin and i will compensate you postage and return the correct coin to you.

He has just opened a paypal dispute trying to claim all the money back.

I have responded to the paypal dispute.

 

What will happen now?  Wouldnt paypal just tell him to return the incorrect coin to me via registered post so i can return the correct coin to him?

 

I have text messages of him demanding compensation in the tune of money.

 

Is there a fraud squad for online buying and selling?

The buyer would most likely have the PayPal dispute ruled in their favour as, technically, the item is not as described (even though it's one item in a lot, it makes the lot not as described).

 

However, even given that, the buyer will receive no compensation from PayPal, as such, the only thing PayPal will do is instruct the buyer to return the entire lot at their own expense for a refund of the original payment. So unless you voluntarily agree to compensate them via the dispute and issue a partial refund or what have you, they won't be any better off with the dispute route, but if it gets to the point where they have to return the items, make sure your receive everything back in the same condition as when sent.

 

At this stage, I would deny any compensation and accept the refund on return option, and even if the buyer's behaviour isn't ideal, I would compensate for the cost of return as it's not buyer error or change of mind (one other thing you need to keep in mind is that eBay allows only 2 cases closed without seller resolution before you can be restricted from selling, and in a case like this where the error is known and the dispute isn't really defensible, you're better off not letting it get to the stage where the dispute is escalated to a claim).

At no point in the dispute did i say that the buyer could return the item too me for a full refund but paypal have notified him i have said that - and they have said if he provides a tracking number they will give him back his 725.00 - all he has to do is put one piece of gold in that bag and put in a tracing number and paypal give him back the lot?

 

If he does that - can i open the parcel in fron of the police or the courthouse to show how many pieces of gold are in the bag.

It is a good idea to open the package in front of witnesses, you can take photos of the process as well. PayPal aren't supposed to refund until you've confirmed receipt of the goods, but sometimes they refund earlier, so what you'll have to do if all the items aren't returned will depend on how / when PayPal issue the refund, but sadly you may have a bit of a trial ahead if they refund and you don't receive back what was sent. (I don't mean a court trial, just the rigamarole of contacting PP and getting them to recognise the buyer wasn't due a refund if they got one because they didn't send all the items back, and if they refuse to acknowledge that, you have the option of then lodging a dispute with the FOS, but all the while the original funds will be on hold until it's sorted, and if they've been withdrawn already, that will mean a negative balance in the account).

Sorry, I shouldn't abbreaviate that all the time ๐Ÿ˜„ It's the Financial Ombudsman Service, with whom you can lodge a complaint if PayPal make an incorrect decision and won't acknowledge and/or rectify it.

this was an off-eBay transaction, they didnt sell for the price on eBay auction and you accepted a paypal payment without a setting up another eBay sale???????????
