Hi All,
Received a IIem not received Paypal claim last night, so of course Paypal has deducted the payment, which is several hundred dollars, so yes does hurt. Anyhow the item in question was delivered around a month ago, as shown by the DHL tracking, also shows was a attempted delivery the day before, but no one was fome to sign for it, so they would have left a card.
Next day shows was delivered and signed ATL FRT DOOR, which i know means they gave DHL permission to leave the package at front door or were ever they nominated it to be left. Now doing that exempts all responsibility for DHL if package goes missing.
So as was a month ago, and had no contact from this buyer, suspect they tried the DHL routine, and possibly Ebay, have now open a Paypal claim.
So have sent the buyer a copy and paste of the tracking showing delivery via Paypal messaging.
Now question should i escalate this claim to speed it up, surely having full tracking showing delivery even to Paypal is enough to close this case in my favour.

They wiill not try to recover the funds from the buyer, when (not if) they refund you it will be a discretionary payyment. When you called Paypal and were told the claim was in your favour you should have noted down the time of the call, the reps name and their employee reference number. Always helps if yu have to call back.
Don't let them play you along for too long, give it a couple of days then call again and tell them you will be making a report to the FOS if the funds are not back in your account within 48 hours.

Good outcome for you.
But I'm thinking that from their initial decision to go in favour of the buyer that the buyer has also received a refund.
This is not so good as its giving them this impression that they can just get their money back on a whim.

Yes agree with that, but i think in this case even though payment was initially refunded to the buyerv by the bots, they immediately escaleted it, which would have removed the funds from the buyers account until it was investigated by Paypal, and then after ruling in my favour transferred into my account.

When a buyer is refunded and a seller appeals I have never known the money to be taken back from the buyer. Paypal always refunds the seller as well as the buyer and wears the cost of their mistake.

Now they are doing same as banks : if they pay by mistake anything into someone's account - that person goes to jail if he/she doesn't pay it back. Especially if the claim is found to be fraudulent in the first place, like the OP's case where he could prove that it was delivered.

Sometimes Paypal makes discretionary payments to keep everyone happy.
And after all, it was their mistake to refund the buyer.
People do not go to jail for a lousy ebay purchase.

A different thing - by the looks of it.
I don't need to repeat what I have already said - as everyone can read.
I said PP is doing the same as banks now (not talking about discretionary payments, and they are also thin on the ground these days)
And yes - you do go to jail if you don't return the money given to you by mistake by the bank (or any finnancial body, for that matter).
Feel free to ask them.
It can be totally their mistake, they put money into your account, you spend it, then they want it back - and it has to be repaid.
Nothing to do with bad Ebay purchases - Ebay doesn't even come into it.

Stawka is talking about you telling me that paypal does not make discretionary payments....if they refund a buyer and it is later proved that they made a mistake they will usually give the money back to the seller from their own funds rather than take it from the buyer.
I have never known them to take money back from the buyer but you say it does happen now.....do you know it for a fact or are you just guessing?

Definitely a fact, one can't geuss that sort of thing!
Was talking to PP about some stuff up (on my part, making a double payment to someone), and that came into conversation, their finance guy told me they no longer "just forget about it" when the buyer is awarded some money that they are not entitled to - PP takes it back from them as soon as the mistake is realized. Even if they are the ones who made that mistake.
Then we talked about banks, they can also by mistake put money into someone's account ( aloads of money) by their own mistake - and prosecute the person if they make a run with it!
