Any items which, because of their nature or because of the item description, appear to be designed for use in sexual/adult activity, including sex toys, used underwear and items used for bondage or S & M activities."
What does eBay think that items such as condoms are "designed" for?
I just did an "Australia Only" search and there are 1294 listings!

I had a peek at the description of the first one that came up and it is pretty clear that they're not being sold for "health and beauty".

What about if someone (who shall totally remain nameless) designed and sells something so not for that use, but it's being advertised on other sites for that use (without my I mean that anonymous person's permission, I might add).

but please clarify that I'm not the anonymous person to whom you refer cos I got nuffin advertised anywhere off eBay except for food business stuff on my own website and I'm pretty sure that you're not referring to that!
OMG.... unless you mean someone has bought a Jewelled umbrella (for example) and is advertising it as an "adult item" on another site and the original owner/designer has not consented to it being advertised/used in this way, is that what you mean?

I was being facetiously cagey, 'cos my post would have come out sounding like "I know this person who has this friend, and they...." so I figured I'd acknowledge / embrace it and, well, be facetiously cagey.
I've edited my bit in the quote up there (added bits in red) - maybe making that clear might prompt a memory or two.
It's just a piece of costume jewellery, btw, nothing overtly sexy about it, either. Remember now?
