I have beeen trying to sort an issue with ebay out for a while now. In a nutshell ebay has been the most evasive and unhelpful organisation I have ever dealt with.
Is there an ombudsman that can help with this issue? I am based in Australia.

You will get your funds refunded when the cancellation case closes. You should have opened a non-paying buyer case. It's quicker, but allows the buyer to pay in the interim.
I fail to see what this has to do with an ombudsman - the terms are clearly listed in the T&Cs which you have said you have read.

As I asked last month - what has this to do with an ombudsman? You have no material loss, and no Australian ombudsman has jurisdiction in Germany.

Now ebay control the shipping the cost has gone though the roof from over seas
and another thing how comes we are paying GST on second hand goods which is breaking the law

*sigh* Here we go again.
Second hand goods have always been subject to GST if the seller is registered for GST....nothing new there at all. Surely you don't believe that second hand shops are the only shops not paying GST.
All low value imports are subject to GST no matter whether the goods are new or used.
Ebay does not control postage from overseas.....sellers do not have to use the GSP if they don't want to but most of them find it convenient for them.....too bad if it is expensive for the buyer.

hey ferret, make a report to the Federal Police if you genuinely believe that the ATO are breaking the law.
