Don't buy it then.

eBay has protections in place for mugs members who buy from shonky sellers, but it is easier to not buy in the first place.

How do you know it's a 'dodgy' item?

Ebay will not just take your word for it.

You may be a competitor or a disgruntled buyer.

Can you give us an item number?       - not the seller's name.
