RE : received item not as described ( damaged )

Can someone please help me with a seller that is playing games with me.  I received an item that didn’t work as described.  The seller continues to send replies that just don’t make sense.  I have emailed him over 30 times only to hear he’s empty promises.  I have opened up a dispute with eBay , they said they would intervene on the 21st of last month if the seller didn’t contact them.  The seller contacted eBay & said he sent the item to me , after that eBay contacted me & said he replied to them , so far that’s the last i’ve heard of my case.  This seller is a smart- ar*e how thinks he can rip me off with faulty goods ,  i was scammed out of thousands of dollars just before Xmas , he’s not getting away with ripping me off.  Can anybody help me please?.

You cannot name and shame on these boards. A moderator will remove the seller details from your post.

You do not need to be emailing a seller over and over. One message through the eBay system is enough; if no satisfactory response resolves the issue, you'd simply need to open a dispute. (At least you have done that, although the 30 emails beforehand were frustrating for you and completely unnecessary.)

If there is no resolution (with you returning the item as you would probably be directed to do in the dispute, and the seller agreeing to refund you upon the receipt of the returned item), then you must ask eBay to step in - i.e., escalate the dispute.

There is a very strict timeframe for opening the refund request and for escalating if necessary. Is the dispute still open? If so, ESCALATE!

Registered in China with horrid, horrid feedback

Why on earth have you wasted your time sending 30 emails to this person?

Stick to the proper procedure and with within the time limit

YOU have all the power, stop wasting it on sending dozens of pointless emails

And no use posting a warning not to buy from them, you bought from them despite all the red negs warning you not to, why would people listen to a warning posted by someone who ignored that many warnings themselves?

Have you read the Buyers Guide at all?

You needed to have opened a case for "Item Not as Described" within 30 days of receipt. Do you have a proper case open? Disputes are usually dealt with within about 4 days.

Seller has to respond within the dispute. Ebay do not intervene as it is a fairly bot driven process. They may only step in if YOU escalate it. Since seller is overseas, they would need to send postage funds if they want it back, or they will need to refund you.

Why are you bothering to message with this seller? Bad sellers willl often keep making promises they do not intend to fulfil in order to keep you waiting more than 30 days. Just make sure you have opened the right case within the time frame and stop communicating with them!

They have terrible feedback  - none of us on the boards would never buy from them.

Yep.  Chinese seller  with horrible FB ,  94.5%  for a high volume seller.

Why you would expect them to speak perfect english, is beyond me.  They probably have just as much trouble understanding you, unless you sent the message in 中文.

$13.79  lesson learnt?

You are way over the top. I am a lot older than you, although I work for a living, and I find gutter's post relevant. It certainly wasn't a lecture. 3 sentences would never qualify as that.

You wanted a solution, you were given several.

If none of them suit you, go your own way. And continue to get 'ripped off' because you won't spend a few minutes reading up on how eBay buying works, or expect other members to do your thinking for you.

You might have noticed that a lot of your post has been **bleeped**. That is because profanity is not allowed on the boards. Explicitly stated in the board conditions that you agreed you had read before you posted.

There seems to be a theme emerging.

OP, your rude post is uncalled-for.

Several of us have given you helpful information, including gutterpunkz (who pointed out that 94.5% feedback is considered “poor” on eBay, that your seller is Chinese, and that the amount you lost is at least not so great as to cause severe financial stress).

Nothing that gutterpunkz posted even began to approach the offensiveness of your post.

You are likely to have alienated many people who give help on these boards.

On the other hand, an apology goes a long way to resolving things.

Hi  HF - Mr indian, Sir  grumpy.   I am actually older than you, probably why I am a bit wiser.

As for lecture, you obviously don't know what one is.

Yes you bought an item for  $13.79, from a poor chinese seller.  dont know if this in anyway relates to the $1000's  of dollars you were supposedly scammed of, appears to be the only relevant  -FB is for a $13.79

item.  If in any event the loss of $1000's  of dollars in another transaction did occur, then you should have learnt  something before this transaction.

Ah well, go and have a BEX....  do you remember them, or were they before your time.
