I have just had an issue with a particular seller which I believe Ebay should do something about.I purchased a Sat phone of this low life. It took two weeks to arrive. Where I live you can't just get a sim card so I needed to go to a town 200ks away to get this. I broke down on the way and after a expensive tow and repair and almost three weeks I finally got home to test it, It didn't work; I immediatly tried to contact this low life with nil results either by msg and phone. I have also been told that Ebay was also unsuccessful. I then went to the resolution centre only to be told it was over the 45 days from purchase. I am at present gathering the details to take the matter to the ACCC.I would love to name this low life. I believe that the resolution centre should be a 45 days from the time of reciept not purchase.I had no article take 6 weeks to arrive

So the fact that your car broke down for 3 weeks and you thus went over the 45 day time limit is the seller's fault? How? Did he remotely kill your car? If he did, it would have been through the sat phone, so it obviously was in working condition. If he didn't, then it is a fair bet that your car issues are not his fault.

Two weeks plus three weeks with the car issue is five weeks. 35 days. Ten inside of the timeframe to open a Paypal dispute. There may be a few undisclosed facts here.

If it took 6 weeks to arrive all the other holdups are irrelevant. You should have already opened a dispute if the item had not arrived by 42 days.

forget the timelines for a moment . . . . . what I would like to know is do Sat phones work everywhere and not just in isolated areas? If yes, then what is stopping one from being tested as working when you are away from home and you get a SIM card for it?
I am just curious, as I think a Sat phone that only works in isolated areas and not cities and built-up areas where there is also satellite coverage would seem a misnomer. Also, why wait until you have a Sat phone to get a suitable SIM card for it? As soon as you buy the phone on eBay you organise the SIM. Why would you wait? AND, could the problem be with the Sat coverage where you live and not the phone? I know this is unlikely, but if it is, then a buyer can hardly blame a seller for their choice of where to live.
edit: I did find the listing and the seller states:
They will work anywhere any time as long as there is line of site to the sky
Please ignore me and this post if I am missing something here. If it doesn't work 200kms from where you live you open a dispute well within the 45 days while you are in a place where you can arrange to return the phone for a full refund.

Even if you live 200km from a town you can still buy a sim card on the net or over the phone from any carrier and it will arrive in the mail even if you only get your mail once a week.

Okay lets get one thing straight, my issue with this seller is simple, no contact, no attempt of any contact not even to ebay. As far as the 45 days is concerned I don't agree with it, it should be a case by case issue but the 45 days is what you get. Sellers and buyers need to be aware about comsumer laws under ACCC and ALL other Consumer agencies The Sat phone was touted as new and as a buyer I should have reasonable expectations that it should work. It may take some time but I wiil eventually win. I may not have got a reply that I would have been happy with had this seller contacted me and may have still had to take it further but at least I would have had my say.

You would think that Sat phones should work anywhere a GPS does, on saying that I think it has more to do with what saterlite system the particular sat phones use. When I was working in a remote area I had two different sat phones and both of them sometimes had problems. One would get through and the other wouldn't and visa versa.The reason I waited was that I intended to go into town to get the card and have it activated then and there. The breakdown just added to things.When I applied to the resolution centre I was two days over. I spent four days trying to get a response from the seller.

having a case-by-case time limit on making a claim through PayPal is simply unworkable.
What criteria would you suggest should be considered when determining how long a buyer has to make a claim? Should it be product related, buyer circumstance related or some convoluted combination of the both?
It seems to me your issues surrounding being unable to make a claim have been buyer circumstance related, and these have nothing to do with the transaction, the product or the seller.
I fail to see what the ACCC will be able to do to help you. I am sure we would all appreciate an update on your 'case' when you can give one. I wish you well in your efforts to gain a solution that satisfies you.
