Hello and Happy New Year!
I was just wondering if anyone has had the same experience as me when buying perfume.
In the Photograph and description I was shown a top designer perfume which I paid $87.95 for plus additional money for postage.
Obviously I expected to get the real thing, however when the item arrived it was a blatantly cheap counterfeit item and the seller refuses to answer my request for a refund.
What am I supposed to do about this? I feel like I have just thrown away my money, I have considered giving up ebay altogether over this one, and believe me I spend a lot of time and money on here.

Go to the website of the business which markets the real item and report the seller for selling fakes. It is then up to them to put them out of business.
Furthermore if it was sent by post, but with no dangerous goods stick attached report the seller to Aust Post
If you paid by PayPal lodge an Item Significantly Not a Describe dispute now, and then as soon as you can, escalate to a claim.
If you paid by credit card commence a chargeback through your credit card provider
If you paid by bank deposit you only real recourse is to take the seller to court (small claims)

If you open an item not as described dispute, you may have to go to a little extra effort to let PayPal know / understand that you can not return the item (a usual requirement for receiving a refund), since (I'm assuming) you don't have a licence as required, and it's illegal to post counterfeit items, instead, you may have to provide evidence from a licensed dealer that the product is fake, and/or evidence of the item being destroyed.

Is it the Dior perfume from the US?
If it is, I am very surprised at it being a fake as the seller has no record of selling fakes...all the negs seem to be for slow postage.
Are you allowing for the fact that the packaging can change from country to country.
And the seller has done nothing wrong with the postage.....they do not abide by Australia Posts's rules.
You will have to get a statement on letterhead paper from an agent or authorised seller of he perfume to state that it is fake. If you are unable to get that then you are wasting your time opening a dispute with paypal.

What would be the point of doing a chargeback if you had already opened a Paypal dispute? Doing that immediately closes the Paypal dispute and if your card provider is one of those that does not cover 3rd party payments and turns you down you would be unable to re-open the dispute.
It is much better to go through Paypal and if you paid by card and your provider covers 3rd party payments keep that in reserve for if Paypal does not do the right thing.

I dont think the picture can throw to much weight to your case unless it states that what is in the picture is the actual item.
Of-course, it matters if the seller shows photo of the real thing and then sends cheap replica. In any case it is the other way around, seller on eBay should mention in their description if the item in photo is NOT the actual item you will receive. The photo is part of the description.
Which ever way you look at it, selling fakes is a criminal offence.

Are you absolutely certain that the perfume is counterfeit? I regularly buy perfumes from the US and more often than not, the packaging is considerably different, and in many cases, they are "testers" which are sent in plain packaging (but are still 100% genuine), but appearances aside, there is no doubt in my mind that I have received the genuine article on every single occasion.

That is exactly what I asked in Post #5 CQ. If it is the perfume I think it is the seller has a huge tunover and good feedback for the most part , although their postage times seem to be a problem at times.
I get perfume from the US and UK and never had a problem, although the Asian countries are a different matter.

Good old Ebay, they know this person is selling fake perfume but still let them sell it!!
