michelle, I can think of two instances where this may happen in the real world in a real store with a real shopkeeper. The only difference between the cases I list below and your experience is that your purchase was online and the seller didn't get a chance to cancel before you paid (as you paid immediately because the price including postage was so good). I'll post again when I think of more as I do feel that there are plenty of instances.
Case 1: a young child goes into a supermarket and goes up to the service counter and plants a $50 note on the counter and asks for a packet of cigarettes. The sale is refused and the money returned to the child. The child chucks a tanty but is ignored. Eventually they leave the store.
Case 2: a young child goes into a Bunnings store in Victoria and collects a few cans of spray paint. They go to the checkout and pull out their cash and want to pay for the paint. The Bunnings employee asks for ID and refuses when the child shows their member card for the local swimming pool (I have visited Bunnings stores in NSW and found that the spray paint is locked behind a 'cage' door. Not so in Victoria). Again, the child chucks a tanty and says "give me a break, I'm going to complain to your boss" and is promptly escorted from the store.
Your gripe seems to be that you were allowed to pay, and your thinking is that you are therefore entitled to the item. If the seller has found out that the item is not allowed to be shipped to Australia then they are right to refund. Previous purchase history is irrelevant once the seller finds out that the item is not allowed to be sent to Australia. It is called respecting Australian Customs.
The other purchase you made may not have been subject to the checks and balances that this purchase was, but that doesn't mean you can keep buying this item in the future. If it is not allowed it is not allowed.
The best you can do is leave feedback to warn other Australians. NOT NEGATIVE OR NEUTRAL, just leave a positive feedback saying "Seller does not ship to Australia due to restrictions. Gave refund". This will act as a warning to Australian based eBayers that the item is not available for shipping to Australia.

can you give us more information about what the item was so we can look at the listing ourselves?
It might be that the seller has made up the restricted excuse, but it may be that it is actually restricted. Without knowing more we can only go by what limited info you trickle out in the thread.

I could be wrong, but I'm pretty certain if an item is confiscated by customs then it's the buyer's problem, not the seller's problem, so there would be no refund by the seller in that instance.

Not again Michelle! When are you going to learn that importing grain type products from overseas is just not on?
You live in Tassie; By your own words a week or so ago, a wonderful place. Yet you threaten the ecosystem by illegally importing grain products time & time again! I'm no Greenie; But the way you keep flouting Aussie import laws defies description! I'm surprised you haven't been caught prior to this time! What bugs are/ were in those lovely banana rice pops for your mice that you last mentioned on here about a week ago?
Your current seller did the correct thing & checked if the items complied with customs laws for Australia. You have been refunded. Look to your local grainstore for treats for your rodent pets.
I'm sure your ratty & micey friends would benefit from the recipes I sent you using good Aussie grains & seeds. My local petbarn store also sells many things for rodents.
Is this just another "Look @ Me" thread Michelle? Do please read back over all the ones you have made with regards to customs & illegal imports (my fave was the used rat cages from UK one!)
You have finally found an honest seller who will not flout Aussie import laws! Kudos to that seller!
If all elsa fails give the critters some peanut butter! I find it very good as mouse trap bait! Got a twofer a few weeks back (male & pregnant female both caught in the same trap in my chook shed!) I can't recall the brand; But they are big black plastic traps from Bunnings - 2 to a card for only $3 - a bargain!

Pumpkin seeds are also a favourite along with peanut butter. I'm getting a new kitchen installed as I type and when the old stove was removed, there was a mummified mouse under it, still with a pumpkin seed in its mouth. It's very rare I don't catch a pesky rodent, so I'm guessing it was the time I got up to an empty trap and no bait left.
Kudos to the seller for not sending it. They can get into trouble too. I'm guessing they have a conscience and didn't want to be party to destroying a whole ecosystem for the sake of a few bucks. I know that quarantine and Dept of Ag have her details, so even if it did make it to our border, it would have been seized. Serve her right for being so selfish.
In regards to the seller having to refund if something is seized, they aren't responsible. Unless it's Michelle, then she gets whatever she likes and gets a refund she's not entitled to.
These are look at me threads to get attention. I don't think I've ever seen so much attention seeking in my life. It's quite sad really. We can only hope she gets caught bringing in something big and gets locked up. Then the rats will be either killed or, heaven forbid, fed something made in Australia. Oh the horror!
