G'Day People,
Some Time Ago (December) I Purchased a Couple of Replacement Cups for a Ninja 900.
When the Items Arrived I Checked them for Condition & Placed Them on the Shelf.
(I Left Positive Feedback at This Time.)
However When I Went to Use The Items They Were the Wrong Type.
When I Approached the Seller They Tried to Fob Me Off By Telling Me That They Did Not Sell Genuine Parts.
My Reply was That Under Aust Consumer Law An Item Must be Suitable for the Purpose Intended.
I Was Then Asked What Did I Want.
My Reply, Either Supply the Correct Items or a Refund.
They Then Asked Me to Return the Items Via Aust Post Tracked.
This I Did But After a Request to Expedite the Matter I Have Not Heard From The Seller Nor Received a Refund.
Part of the Problem Now Lies in the Fact That When I Try to Obtain Assistance From Ebay My Original Request is "Greyed Out" And So I Can't Progress Any Further.
I Have Been With Ebay Over 21 Years And This is the First Occasion on Which I Have Been Treated So Poorly.
I Not Only HAVE NOT Received the Items I Paid For, But I Am Also Out of Pocket $14.95 for the Cost of the Tracked Return.
I Contacted Aust Post to Ensure the Items Have Been Delivered Which They Assure Me They Have, However I Was Also Informed That This Sellers P.O. Box is Set Up in Such a Manner That Apparently They Don't Sign for Any Tracked Items, So Where Does This Leave Me ?
Any Suggestions or Advice Would Be Appreciated.

eBay’s Money Back Guarantee only covers you for 30 days from the date of delivery.
Your seller isn’t going to refund you.
The only possibility for redress at this stage is PayPal Buyer Protection - if you paid by PayPal. PayPal covers you for 180 days from date of transaction.

Why on Earth would you pay for the seller's postage? The minute you did is the very same minute that you made a non-refundable, non-deductable donation of $14.95. I just don't get why anyone would do this.
Would you like to pay for my postage labels as well?

A Paypal claim is meant to relate to the condition of the item, at time of receipt. Even though the condition has not changed, the fact you have left +FB could be a problem

Unfortunately Folks I am Old & Trusting.
I Never Expected to be Treated This Badly By an Ebay Seller.
I Have Always Treated Others With a Little Kindness & Respect.
After 21 Years & Over 1500 Purchases I Like to Allow Others a Little Room. We All Make Mistakes.
In My Opinion, It Seems Ebay Doesn't Care About the Crooks & Dudders in the System.
I Shall Have to Hand This Matter to the ACCC or Perhaps A Current Affair.
Not So Concerned About the Money I've Lost So Much as How Many Other Ebay Members are They Going to be Allowed to Rip Off.

Nothing ACCC can do. And I would seek legal advice before attempting to get the media involved in anyway, as you may be inviting a lawsuit for damages, after all the time limit for any claim via ebay has long passed.

I think your problem will be the amount of time that has passed.
This would be the case with ebay or with a retail store.
It varies with different items but with a lot of things, you only have 30 days in which to return something that is faulty or not fit for purpose. On ebay, the limit is 30 days.
I don't think A Current Affair would cover your case, nor ACCC. You've left it too long.
Your seller's cups must fit one of the ninja models but obviously not yours.
Whenever you buy something from anywhere, you really need to not only look at it but test it out within the month, or else you risk having something like this happen.
You are way beyond an ebay claim but you are not out of time for a paypal claim if you paid that way.
Your claim would have to revolve around the fact that you were not sent the correct replacement part as it was advertised as for a ninja 900 but the part you received does not fit a ninja 900.
Normally, if you open an ebay claim within a month, the seller would have to supply you with a postage label out of their own pocket & ebay would oversee the refund process. But you have tried to arrange it privately.
I agree, the seller didn't play fair with you, but ebay did not oversee this transaction.
I suspect you have lost your money. Ebay won't care how long you have been with them & they won't do anything about the seller as you initially left good feedback, you never opened a claim within the month and only now after 4 months are complaining. Ebay does not cover warranties, only a refund on items that have a problem when you receive them. Remember, most of ebay processes are computerised these days, you are dealing with an automated system, so you need to keep within the time guides.
Where it leaves you is out of pocket. All I can suggest is you write to the seller again, attaching tracking details and outlining your order number etc, asking for the refund. I doubt you will get it but you can only try.
