Seller Cancels Auction Sale After Item is Paid for. / Bargains Depend entirely on Goodwill

Last Friday I had the interesting experience of winning a Nikon 1 J3 mirrorless camera with two lenses at a very good price. I immediately paid for it with Paypal. 19 minutes after the end of the auction, the seller then cancelled the sale, citing the reason as,
I'm out of stock or the item is damaged".

Plainly she wasn't out of stock, and it strains credulity that she suddenly discovered the camera was found to be damaged within 19 minutes of my winning it. I reported the seller to Ebay.

Ebay's response included,

"I assure you that I have warned the seller and we will monitor their account to make sure that if they continue to cause bad-buyer experiences, we will take further actions which could lead to restrictions or even indefinite suspension."

As best I can see it – sellers can break their Ebay conditions and their contract with me with impunity.

Plainly, if this pattern is repeated by a frequent seller, Ebay will do something. But it appears that casual sellers never have to worry about getting what they perceive to be a dud price for their item. If they do, they can just cancel the sale and claim the item was damaged.

To make matters worse, the camera was listed as not having a charger, which I bought from another seller after winning the camera. Despite my requesting that he cancel the order, it is on its way to me, and I have paid $10.98 for a useless charger.

Anybody else had this type of  frustrating auction experience?

Well said ra157.  I can't remember any fish. Though there have been some pirhanas attacking you for speakiing your mind and excercising your right to debate on an issue that was not only up for discussuion but one of interest as well.

Well .. .. so, all I am doing is supporting ra157's right to talk openly about a negative experience. Nothing wrong with that. There's a few people that don't like people speaking out. That's just too bad as we all have a right to free speach.

 

The reason why I support ra157 is that this business of a seller withholding an item because it didn't fetch the desired price is a bit more widespread than many people think. It's auctually the buyers who keep ebay going because they represent the demand.

  • If the seller cancelled the sale because the price reached was too low, that was unfair of him/her.
  • We don't know whether or not the seller did cancel for that reason.
  • Whatever was the reason, the seller has received a defect for cancelling the sale for the option chosen.
  • Sellers who consistently do this are very poor sellers and should not be selling; some sort of punitive action needs to be visited upon them.
  • In fact, sellers who do this more than a few times will end up with sufficient defects to impact their ability to operate on eBay.
  • The buyer missed out on a bargain.
  • The buyer was not robbed.
  • Honour is important.
  • Honour without mercy lacks an essential ingredient.
  • The seller was inexperienced.
  • The seller attempted to cancel the auction / sale by ending the auction early.
  • There is no point in argument, debate or discussion with anyone who has an unshakeable view materially different from one's own.
  • A lively discussion can be more fascinating than dancing the tango with an Armenian goat.
  • There are more things in heaven and earth than are dreamt of in our philosophy, and some of them happen on eBay.
  • Coffee is important.

The right to free speech is in the American constitution, but it's not in the Australian constitution.

 

Furthermore, freedom of speech doesn't mean freedom from criticism.
