shows Delivered (out of time frame), but is Returned To Sender, how I get refund?

Hello everyone.

How can I get refund?

The status in the ebay system shows Delivered, but far late after expected time frame and if you look the tracking history after "Delivery" statement it continues and end up with "Returned to Sender"

I bought and paid an item.

The auction was clearly written " Delivery: Estimated within 4-8 business days". The email I got also have Estimated delivery time frame.

But seller shipped the item on the last day of the written time frame.

Very long after all time frames the item arrived on the address and was immediately Returned to Sender because the address is not actual any more. No one have signed that "Delivery", package just have been returned to sender

However, ebay page shows Delivered but if you open the tracking history after the record Delivered, tracking continues with Returned to Sender in few more records showing that

Now the seller have both, the item and the money and refusing refund.

I opened ebay case "Item not received" to get refund . The seller refuse and no communication. If I escalate the case will I get refund? What can I do to get refund?

How did you pay - was it an echeque payment through paypal which takes several days to clear?

If you have moved and the parcel has been sent back to the seller you need to offer to send the seller money for postage so they can resend it to your new address.

I think you have all misread funsofts post, even though he has not made it very clear.

he has not shifted address ,look at his post , he says it was delivered ,it was not signed,it was returned to seller , [he returned it to the seller, he had to be there.

this is what he says because the estimate delivery was 4 to 8 business days , he is peeved off at the seller because the seller waited until the 8th day to send the parcel , so when the parcel came very late in his words and because the seller sent it out 8 days after it was paid for , the buyer decided to send back the parcel ,because he was peeved off, the buyer had the tracking number and thats why he knew when it was first posted.

now i have no idea what the policy to that is , but he should of recieved the parcel and maybe give the seller some low points on his feedback or maybe mention something on the feed back , but he wanted to teach the buyer a lesson , but it might backfire.

thats why he is asking[will i get a refund ]  and i think he will find it hard to win a case of [ item not delivered].

I looked for help and all participants here are only SELLERS that helped me really a lot to settle that matter and to realize these things:

1. sellers have ultimate rights to ship whenever they want and the written terms is not valid

2. everything written in the auction is compulsory policy items for the buyers, bit not for sellers because for them is valid so called "not compulsory policy items"

3. if a seller ship item not in a written time frame, it is a buyer fault, and we buyers automatically becaming a serf (a middle centuries castle peasent stick to leave only at a given property within the castle area during all his live, because is forbidden to move to another castle area)

4. When the seller decide to deliver out of written time frames, the buyer turns into felon in probation and has to provide his new address. That is what criminals on probation do when they are out of jail they have to go in the police department every day to state their new resident address so if they move on another address the police should be informed immediately. So if seller's delivery is out of any written time frames then buyer = felon in probation. I thought I am free buyer have rights to decide or not give all my new addresses to some unknown sellers with delayed supplies out of the time frames. So I was wrong. How long time I have to expose my new addresses to unknown people in ebay? a month? a year? 10 years? Who they think they are?

5. Buyers don't have any rights. When I asked am I have rights, was not because I don't know my rights. I know my rights in EU because my origin, but here in Australia I am not sure about differences because Australia is not in EU. If I were in EU I know what directives protect buyers and would not write this topic anyway

6. If I don't want anybody else's opinion I should not post on the Internet!

However "anybody else" here is only SELLERS. Hence it automatically turns into If I don't want SELLERS opinion I should not post on the Internet!

What about the opposite - If YOU don't want anybody else's opinion YOU should NOT READ the Internet? Maybe the Internet is only sellers property or what? What if I tell you that I have same right as you to write the Internet?

to funsoft i can understand you are peeved off because as you say it was not posted until day8, but if you are not happy with the sellers service then you coud of complained to ebay or reflect his points on feedback ,  you have to understand that its only an estimate only , things happen ,in life , the seller might of been sick or anything.

personly if this is right , you have sent back a delivery , that was meant for you, [you cant say not delivered surely]

and if you did shift address  [why would you order something that close to shifting]have a nice day

How can you be so sure that the buyer sent the item back?

If that is the case then he cannot claim the item was not received.

Because it has tracking number it is SAME TRACKING number!

it is written that the package went on the address and then is returned to sender because I not live on that address any more. All this is shown on the tracking number that seller provided. And now seller have the item and the money

And yes, when the auction is made is clearly written 1-3 DAYS TO SHIP, seller have not specified long shipping term in the auction.

He shipped item after 2 weeks when it was the final DELIVERY day. He should ship until 3rd day, and the item will not arrive out of any time frames when I not live on the address
