Hello everyone.
How can I get refund?
The status in the ebay system shows Delivered, but far late after expected time frame and if you look the tracking history after "Delivery" statement it continues and end up with "Returned to Sender"
I bought and paid an item.
The auction was clearly written " Delivery: Estimated within 4-8 business days". The email I got also have Estimated delivery time frame.
But seller shipped the item on the last day of the written time frame.
Very long after all time frames the item arrived on the address and was immediately Returned to Sender because the address is not actual any more. No one have signed that "Delivery", package just have been returned to sender
However, ebay page shows Delivered but if you open the tracking history after the record Delivered, tracking continues with Returned to Sender in few more records showing that
Now the seller have both, the item and the money and refusing refund.
I opened ebay case "Item not received" to get refund . The seller refuse and no communication. If I escalate the case will I get refund? What can I do to get refund?

But this is not the case, because the package is not deliverable and according AusPost laws they do Return to Sender. And it is done on the same day, no 10 days collection wait and that's how is returned immediately.

The seller break ebay's 3 business days rule for shipping. It arrived late of any promised time frames and was returned to sender immediately.
Do you think I have rights?
Or the seller keeps the item and my money is just fine? I don't see any delivery here aren't you?
My new address would need a huge postage fee so I wouldn't buy from that seller
This sounds like you read an eBay ESTIMATED time of delivery (which is based on when the seller indicated he/she would post), and assumed the item would therefore arrive before you moved out.
If this is the case, maybe the new occupants marked the item as "Return to sender" or the delivery person, finding the premises unoccupied and with no forwarding address, marked it for return.
If the seller posted to the address he/she had, in the time frame he/she said they would (all of which you seem to aknowledge), I can't for the life of me see they they have done anything wrong.
This being the case, you should attempt to open a dialogue with them, admitting YOUR mistake, and make some arrangements for the re-posting (at your expense) or possible refund.

yes I will point you the direction, try to read the auction rules before to click button Submit/Continue You will see something like
"Handling time"
This is the number of days it will take you to post the item after receiving cleared payment. Buyers like to get their items fast, so set a handling time between 1 and 3 days.
If you select a longer handling time, please note that buyers will be notified of the longer handling time when they view your item

that is not and ebay policy at all. you can't request a refund after the item has been sent and delivered and returned LOL

I thought that everything written in auction page is just exactly compulsory policy items.
But it appeared as "not compulsory policy items"

Ok then, therefore same logic should be valid to me as reciprocal side of buyer - everything written on buyers pages is just "tips for effective BUYING- not compulsory policy items."
Sounds reciprocal doesn't it? and I am not compulsory buying item

Has the returned package definitely been delivered back to the seller, or is it still in transit? That's quite important.
Regarding handling times... A seller can have up to 30 days handling time on eBay, they are allowed to choose it themselves. eBay recommend sellers have a 0-3 day handling time, but there is aboslutely no policy that states a seller must ship within 3 days (unless the seller has selected a 3 day handling time - if they had a 3 day handling time, then yes, they should have honoured that).
The handling time forms part of a seller's terms, so when you buy an item, you agree to those terms, and eBay can not dictate what those terms are, it also only refers to business days, so if you buy late on a Friday from a seller with a 3-day handling time, it is scheduled to ship by the following Wednesday.
Regarding estimates. I bought some items today located in Malta. eBay estimate it will arrive tomorrow at the earliest.... Unless the seller has a teleportation device, there is no way the item is going to get to me tomorrow - that clearly shows how reliable their estimates are.

Don't buy from me then, I have a 5 day handling time. A seller can have up to a 30 day handling time.
If you post the item number of the transaction we can probably help you with what to do. Ranting at the members trying to help you is pointless because you won't get the help you need. Changing your address in eBay/PayPal is YOUR responsibility. The seller isn't to know that you have moved. If you were so close to moving, why not update your address when you paid, then the item would have been waiting at the post office for you when you moved.
As for the estimate, that is exactly what it is. An estimate. Check the meaning in the dictionary. There are a multitude of reasons why something may arrive after the estimate that eBay put in the listing (who incidentally are not Australia Post and have no control over Australia Post). Some of those reasons are delays in the postage system (oh the horror!), bad weather, road closures, trucks catching on fire.
As for the seller posting after 3 days, unless you give us the item number so we can check his handling time, we can't help you. Sometimes sellers forget to mark an item as posted. Some never mark items as being posted. Some remember several days later and mark it as posted. I had one marked as posted a few weeks ago 2 days after I received it.

This is the fifth drama you have had in the last six months out of 22 publicly recorded transactions with feedback. This time its a invalid address which regardless of postal estimates/ guidelines/expectations has caused this drama.
Stop blaming this seller and learn how ebay works. Learn what is policy and what are guides.
A correct shipping address is ebay policy. Shipping times are guides.
