I was reading up on this today, as the trial started Monday.

The senior Baden Clay was on the stand today and gave evidence about something his wife told him about his daughter in law..................................I thought they usually objected and called that heresay?

Don't they do that in Australia? have I watched too many American crime shows?

no, it is usual, they were asked if they wanted to do it over the weekend apparently but they said no. I think if they fail to reach a verdict in a certain time, they will be kept back to do so.

The jury I was on was not a murder trial but we were told to bring a suitcase for an overnight stay, in case that happened.

Probably a good thing to spend the extra time deliberating..go over everything thoroughly.

I don't think people should be taking photos of GBC's family, especially if they are posting those photos on social media sites etc. As the family are out in public I guess there is no law to stop others taking the photos.

I really thought the jury would've been able to make a clear decision by now, the fact that they're taking so long means there must be some doubt involved.

There is always doubt, I guess, hopefully they are deliberating over whether it is murder or manslaughter.

12 jurors, must be a unanimous decision. Only takes one that doesn't agree with the others to delay things. Circumstantial evidence only. It would be hard, and pressure is on to make the right decision.

Would it be unlikely, going by the circumstantial evidence, that all 12 jurors would have the same view of guilty of murder shortly after they were sent out to deliberate?

One juror wanted to read these comments below again, which the Judge then read out to the jurors.


"Justice Byrne told the jurors they might find it puzzling but he must read the relevant lines to them in the court.

"If you conclude the accused lied because he realised that the truth would implicate him in killing his wife, you would need carefully also to consider whether the lie reveals a consciousness of guilt merely with respect to manslaughter as distinct from also revealing an intention to kill or to cause grievous bodily harm," he said.

"You may only use the lie about cutting himself shaving - if it was a lie - as tending to prove the element of murder of an intention to kill or to cause grievous bodily harm if, on the whole of the evidence, the accused lied because he realised that the truth of the matter in that respect would show that, in killing his wife, he had intended to kill her or to cause her grievous bodily harm.

"It may be that, even if you were to find that the accused lied about his facial injuries because he realised that the truth would show him to be the killer, still you would not conclude that the lies shows that he realised that the death after scratching him with her fingernails would show that he had killed her intentionally."

I originally thought Gerard Baden Clays bail was denied in 2012 because his children would be able to supply

 

evidence that would incriminate him beyond reasonable doubt and the crown was worried that he may influence or

 

taint their evidence through coaching.

 

The childrens evidence however stated that their was no barney, no shouting and nothing untoward occurred that

 

night.

 

Can anybody tell me why GBCs bail was refused twice now that we are all privy to the crowns evidence???.

 

If GBC is found not guilty who will explain why he has been incarcerated to his children?

 

If GBC is found not guilty I can hear the complaints now for the mega dollar payout that he can look forward to for

 

wrongful arrest./deprivation of liberty.

 

GBC was found guilty in the media Kangaroo court well before he was even charged

 

He was hung drawn and quartered on hearsay and that hearsay has not manifested into evidence. I bet the crown

 

prosecutors and the police officers who fabricated hearsay evidence that denied GBC bail are now shaking in their

 

collective boots.

and before someone comes along and says " so you think he is not guilty?"

 

Here is what I think.

 

 

I think the evidence supplied at the trial makes it impossible for me to be sure that GBC either killed his wife or disposed of

 

the body after death whether accidental or premeditated.

 

Only one person needs to think like me on that jury to make the decison less than unanimous....
