What would you do? Bikers vs SUV

http://edition.cnn.com/2013/09/30/us/new-york-bikers-road-rage-video/

The New York City Police Department said a man driving a Range Rover with his wife and 2-year-old daughter inside Sunday struck a motorcyclist on Manhattan's West Side Highway, breaking his leg.

The SUV driver pulled over, and the bikers surrounded his vehicle, hitting it and spiking the tires, police said. The driver pulled away, hitting three more bikers in the process, police said.

Should the driver in the SUV be charged?

What do you think of bikers?

What would you have done if you were the driver in the SUV?

Look at where it happened. USA. They take the peoples right to self protect themselves, family & property very seriously.

It is covered in their constitution.Unlike our law system they reconise this fundermental right so  the driver does not need to be charged.

It would be ridiculous if the suv driver was charged.

He was the victim of a vicious lynch mob.

same here in australia

the fello who bought my torana a9x, had a genuine a9x ex race car that was licensed who sold it to a fello i knew

looking at the car and underneath it with the new owner he said most race cars are rough as guts underneath lol

thats not true because touring cars race on the road or on street tracks

anyway, whilst the previous owner of the race car bought my car he said he was at a pub with his race car and bikies bullied and hassled him because he didnt drink! lol, to the point of him escaping the premises in his race car, but... no.... such is the pack mentality of a bikie gang they would leave him alone and took chase, it resulted in him running over one of the bikies! lol, and because it was a 400hp + race car he was able to escape!

he didnt get charged and rightly so because it was self defence

Signatures suck.

I agree and it's mostly irrelevant twaddle anyway.

I was just reading police news, bikies feature in two stories including a shooting where one man died. Hellos angels, I think it said,

I'm not sure tht its helpful to cite a precedent set in an English court when discusing an inceident that happened in USA.

All Federal Courts and 49 states of the United States of America use the legal system based on English Common Law.

Looking at the article which I think meep quoted earlier:

http://www.dailymail.co.uk/news/article-2441285/Bikers-wanted-highway-Police-say-gang-beat-SUV-drive...

I wonder how responsible it was to put the SUV drivers name and photo online? Actually I was wondering about the facebook photos generally - would they be used with permission?

From Wikipedia:

However, it is important to understand that despite the presence of reception statutes, much of contemporary American common law has diverged significantly from English common law.[30] The reason is that although the courts of the various Commonwealth nations are often influenced by each other's rulings, American courts rarely follow post-Revolution Commonwealth rulings unless there is no American ruling on point, the facts and law at issue are nearly identical, and the reasoning is strongly persuasive.

Early on, American courts, even after the Revolution, often did cite contemporary English cases. This was because appellate decisions from many American courts were not regularly reported until the mid-19th century; lawyers and judges, as creatures of habit, used English legal materials to fill the gap.[31] But citations to English decisions gradually disappeared during the 19th century as American courts developed their own principles to resolve the legal problems of the American people.[32] The number of published volumes of American reports soared from eighteen in 1810 to over 8,000 by 1910

If they start slashing my tyres and attacking my vehicle I'm not going to hang around to see how bad it gets.

I doubt you would either.

what other option did the driver have to remove himself and his family from that situation?   how would you have handled it if you were confronted with exactly what the driver was confronted with?

I would hope you wouldnt deliberatly run someone down just because they got in your way which is what started the sequence of events according to Jimmeh and him being a local would have more info then what we have been fed.

And if you were driving down the road and saw a heap of foot ball fans blocking the road would you just attempt to drive through them because they shouldn't have been there?

Would you be surprised when they went nuts and attacked you?
