Did you email eBay CS or phone them. If you emailed them, they basically have no idea. I would go through the Help pages and request a call back, you're much more likely to get someone who can actually help with you with this. If you responded via My Messages, the. It is eBay who are at fault not you as it is not something you have control over. If you rang eBay, I'd still do the call back and keep purservering.

You've got a 3 day suspension from sending messages, Nothing else. People can still buy, you can still list. Your life isn't over. If you are willing to spend thousands going to court over a 3 day ban from sending emails, more fool you. I am telling you now, it will be you out of pocket, not eBay.

I think terms and conditions probably have ebay covered. In any event such matters will not be heard by a small claims court.
As far as Breaching privacy laws ebay will argue that technically you gave out your details, not them. I think your free lawyer
is probably starting to run a mile.

How did you manage the have a summons served within one day. Please let us in on the secret of getting the legal system to work that quickly.

In the OP,s defence, it can be done. My son had his licence suspended on the spot for a false and malicous claim by a dodgy police officer. We went to court, had a preliminary hearing and had the licence re-instated, all within 48 hours. The cop had not even lodged his paper work at that stage. The judge noted to the police prossecution that based on the evidence we had presented, the charge was unlikely to succeed in court and they should seriously consider wether to proceed with the case. They went ahead anyway.
Eventually many months, several adjournments, lots of stress and thousands of dollars in lawyers fees later, the police withdrew the charges...................................................................... five minutes before we where to enter court for the final hearing...................absolute b@$tard$
