Hi I have a problem and need some advise from a computer expert. My account has been restricted for providing the customer my email address. Now I understand you are not supposed to do this it's a big no no.
My problem is that I never provided my email address, I replied to a question from a customer using my gmail account but still through the eBay message system for some reason the time stamp that is put on all emails has put my personal email address in. Talking to eBay they say that's not supposed to happen but its still my fault. Am I right in saying I don't control this part, that eBay are responsible because I used the correct way to respond? Really upset that I have been restricted for what amounts to be a tech fault but eBay are just not understanding and are saying it does not matter you are still banned. Is this fair? What options do I have? I can prove all of my claims with screenshots to show what happened. Why are eBay being so stubborn? Really need someone's help as this is costing me $1000s at this time of year. Thx matt

Did you email eBay CS or phone them. If you emailed them, they basically have no idea. I would go through the Help pages and request a call back, you're much more likely to get someone who can actually help with you with this. If you responded via My Messages, the. It is eBay who are at fault not you as it is not something you have control over. If you rang eBay, I'd still do the call back and keep purservering.

You've got a 3 day suspension from sending messages, Nothing else. People can still buy, you can still list. Your life isn't over. If you are willing to spend thousands going to court over a 3 day ban from sending emails, more fool you. I am telling you now, it will be you out of pocket, not eBay.

I think terms and conditions probably have ebay covered.  In any event such matters will not be heard by a small claims court.

As far as Breaching privacy laws ebay will argue that technically you  gave out your details, not them.  I think your free lawyer

is probably starting to run a mile.

No I can not list thing so you don't know what your talking about. If you don't have something constructive to say best not saying anything at all. Actually you don't sound like you know how things work except trying to put people down when they are asking for help, next time unless you actually know don't write a reply based on what you think! Do you know how the small claims court work cobber I don't even need a lawyer. Ebay have refused the summons which means I can ask the judge to make ruling they don't even need to be there but that not the point. I suggest not reply to these things unless you have something helpful to say. I don't give up easily and it's a principal thing like the person said above they may not be responsible for the error but they are certainly responsible for suspending my account over it. Get your facts write next time before you reply

You came in here 24 hours ago asking for help and already your case has progressed so quickly that you know ebay has refused the summons.

How did you manage the have a summons served within one day.  Please let us in on the secret of getting the legal system to work that quickly.

By the way, I suspect Tippy knows more than you do about ebay....this is just her posting ID....she does not use her selling IDs on the boards.

In the OP,s defence, it can be done. My son had his licence suspended on the spot for a false and malicous claim by a dodgy police officer. We went to court, had a preliminary hearing and had the licence re-instated, all within 48 hours. The cop had not even lodged his paper work at that stage. The judge noted to the police prossecution that based on the evidence we had presented, the charge was unlikely to succeed in court and they should seriously consider wether to proceed with the case. They went ahead anyway.

 

Eventually many months, several adjournments,  lots of stress and thousands of dollars in lawyers fees later, the police withdrew the charges...................................................................... five minutes before we where to enter court for the final hearing...................absolute  b@$tard$
