A buyer in France has opened an item not received case after 55 days from the sale. Although the item was not formally tracked (large letter), the customs slip UC number has been recorded by France Postal Service as being received in the country and delivered on 5 November. However I think I am right in saying that eBay will find in the buyers favour if he escallates and issue me with a nasty defect as their seller protection requires signature on delivery? I have a few days before I need to resolve with the buyer who has gone all quiet since I provided him with the tracking informatrion.

Well you have to laugh. They have removed the defect for case closed without seller resolution and replaced it with a defect for being out of stock. Same transaction!! Oh well luckily I really love talking to Customer Support.

Geez, the Christmas grinch that is eBay is in fine form at the moment! Hope you're not on the phone too long getting that defect removed. They're unreal aren't they?

Good grief, they're on a roll with that at the moment. (I also currently have two erroneous 'out of stock' defects. ).
I hope you get yours sorted without too much pain, I'm not sure I have the resolve for that at the moment (post-Christmas lethargy ).

I find that the Out Of Stock defects pop up when you refund some overseas buyers regardless of the reason (typically item not received). eBay will always remove them once contacted.
Mine just disappeared overnight. Never got to chat to Customer Support.
