Ebay's Restricted adult items policy includes the following:
"The following magazines and books can be listed as long as the listing and product don't contain nude images or explicit content: Playboy, Playgirl, Mayfair, and Penthouse"

It seems that magazines such as Penthouse (the product) contain nude images - that's basically one of the main reasons the magazines exist, so I'm concluding that selling old Penthouse magazines on ebay would be in breach of the policy.
Am I correct?

I think it's allowed if the listing and description (i.e. photos) don't have nude images. There are plenty listed.

They are fine to sell as long as you stay within the guidelines.

We do allow your type of magazine to be listed depending on how it will be marketed. Also, when listing the item, it should not show any nude images.
eBay is allowing these type of magazines to be listed due to the general availability of these items in bookstores and because they often have higher collectibility.
Item should be marketed for collection purposes and not related to any sexual information.

At the same time, these type of listings may not show nudity upon listings and should be marketed appropriately (e.g., best for people who love collecting ....).
Yes you may list your item and it will still be subject for review. If in case the item is not allowed, then it will be simply removed without any violation recorded and an email will be sent but as long you do not show the nudity on your listing, there will be less chances that the item will be removed.

Most of the old mags are pretty tame compared to what anyone can access on the internet. The articles really are the most interesting part of them these days...........
