How is eBay legally allowed to NOT display price inclusive of GST?

Prices on Australian websites are supposed to show prices inclusive of GST, aren't they?

I just bought something from the UK and GST was added *after* I confirmed the purchase, with no indication from ebay that this would happen, nothing on the item page to say the item was subject to GST. I'm not complaining that I have to pay the GST, I'm saying ebay needs to show the FINAL cost on the item page, or at least say that GST will be added.

The total price, including GST, is on the invoice before you pay.

From the ACCC website accc.gov.au/business/pricing-surcharging/displaying-prices

"When you present prices to your customers, you must state the total price of the good or service as a single figure ... This should include any tax ... e.g. GST."

and

"If you promote a price that is only part of the total price, the total price must also be displayed at least as prominently as the part price." (emphasis mine)

does the ACCC website you have quoted from state that this requirement applies to imports?

No, the same law does NOT apply to items being sold overseas. I'm not going to bother looking for the post I did with the link to the relevant ATO page but the ATO only stipulates that somewhere on the page it has to say that GST may apply.

When it comes to tax law I'd imagine the ATO trumps the ACCC.

What I said was aimed at galla2016, by the way.

There are more wannabe lawyers on ebay than you can poke a stick at. They wouldn't survive in a courtroom for long because they take one part of the law and ignore the rest, but they think knowing one part of the law makes them an expert.

I knew that.  Some posters would have been quick to reply, but I don’t have a trigger finger when it comes to replying.

I will post the link to your thread so that galah can read up on the GST links provided

I am so sorry galla2016.  When I posted a shortened version of your ID my mobile device changed “galla” to “galah”.

It won’t happen again as I have now used galla in this post.  Smiley Embarassed

stop that.

I let it go when you chided me for posting a blank post (see, no trigger finger).  The ‘back’ button on my mobile is right near where the ‘post’ button appears on the screen.

I can’t help it when someone has an ID that when shortened causes caniption on my mobile.
