I sold a new tablet nearly a month ago, only took it out of box to test and photograph. Worked perfectly.
Posted express to buyer in Australia, it sat at his post office for a week before he picked it up. Later I checked his feedback he is in Hong Kong with AU mailing address.
Now he is now claiming he resold it new to a NZ customer and apperently they said screen burnt out and wifi don't work.
Warranty is now nul and void as it was supposedly sold to NZ.
I have asked him 4 times for a copy of the NZ invoice, name and phone number, he is just beating around the bush asking where to send it back to me. Wont give me any info on them.
I don't believe this is the same tablet that I sold to him or even if he has resold it.
I called ebay and they said he has not sold 1 of my tablet models to anyone, NZ or anywhere. He sells tabs and phones on ebay.
When I told him I checked and none of my model tabs have been sold since mine he is now he is claiming he didn't sell it throught ebay. He still refuses to give me the details of the supposed NZ buyer.
I have all the serial numbers photographed of mine.
Ebay said to communicate with the buyer which I have done from the start.
Has anyone gone throught this sort of thing and what did you do.

I have now received a return request from ebay stating he wants a full refund so I will call ebay to get back to me again.

I presume he then he sends his purchases (he makes many similar purchases) back to Hong Kong in bulk.
His first message to me was on the 23rd Aug.
Don't know how he had the time to get it to Hong Kong then to NZ if it is indeed my item.
My advice re the case that is now open, stick to the facts, you have evidence to support a case in your favour through the buyers messages, so stick with those facts, the things the buyer has admitted. Refer to the buyers messages and that they do not even have possession of the item due to onselling to someone else outside of Australia.
IMO do not jeopordize your chance to win the case by claiming to eBay things like the above bolded - these types of matters are just speculation,.
Unfortunately it may be that the inititial customer service rep that you speak to is "unable to" resolve the case in your favour or advises something inappropriate. If you are not satisfied with their response, politely (but insistently) request to speak to a supervisor.
IMO do not attempt to argue it out with that initial rep, just escalate to a supervisor. If a supervisor is unavailable, they may have to do another callback - worth the wait IMO.

Thankyou for your help, ebay said just to ignore return request as he resold to NZ, they also read all messages from him and said if I receive any tablet mine or otherwise to call them back.

Be a bit careful of ignoring it.
Once it has been open for 4-days (I think it is???) then he can escalate the case.
If that happens some other ebay CSR may simply close it in his favour because you have ignored it and not provided a solution.
Then you would have to go thru the appeals process to get a new resolution. More difficult.
I would be very careful about this as it stands and perhaps even speak with them again. Make sure they put notes on the file.
It's better for you if they will review the evidence you have now thru messages and close it right away with no penalty to you.
Make sure that you have uploaded the tracking information onto the case itself. Don't just rely on the fact that you attached it to the original transaction. Upload it again in the case.
There is another possibility too. If he does not like the fact that ebay finds against him (if indeed they do) then he could even try raising a further case thru PayPal. So it may not be finished yet.

Thats kind of good.
Would be much better, and fairer, and less stress, if eBay closed the case in your favour.
Also would be better for the (misguided) buyer to know where they stand too.
Please keep updating this thread as it progresses to a closed case, as it is lvaluable for others to understand the processes that eBay may adopt to manage a return in these circumstances.

It is a return case.
The only tracking you can upload on a return is the return post label.
Uploading anything to this case may trigger a series of unfortuante events.

Apart from the eBay side of things, this guy sounds like a right tool.
The transaction (contract) was between you (the OP, not cats LOL) and the buyer - item received, I assume feedback left? over and done.
What the buyer ddecided to do after that, sell it, dump it, is completely up to him as it is now legally his product.
He chose to re-sell and now the contract is between him and his buyer.
This is not a warranty thing, he can not claim from you as he may from a manufacturer as the thrid party, leave it alone, it will hopefully just go away.

I hadn't left feedback and neither did he, something didn't sound right from the start, I was about to leave feedback then realised he hadn't picked it up from the post office after 6 days, then I checked his store and he was infact from Hong Kong but I was given an Australian address to mail to.
I had a feeling that he was trying it on me with a broken tablet of his that he was trying to off load on to me.
Ebay checked his sales and told me he hadn't resold it. When I told him what ebay said, he said he didn't sell through ebay.
I'm betting others are going through this with him also as he purchases lots of similar items and resells.

I received an email yesterday saying they are reviewing his case, this morning I woke up to find his paypal payment has been taken out saying payment pending.
Should i ring ebay again or paypal?
