Right, I now have solid ground for defimation of character against ebay and any buyer that has left negative feedback whether it be in the positive, neutral or negative feedback check box.



Any one whom has previouslt contacted a lawyer willact as an indepented witness and is asked to please contact me.

I do understand you D*G and it makes sense.


as you said how ever, Given that, have you asked yourself why, in over a decade of operation, no one has (to my knowledge), successfully challenged (in a legal capacity) the feedback system and the way it currently operates?



eBay use to once upon a time not so long ago allow sellers to leave neg feedback aswell, there for the seller could defend their character by warning other sellers of this buyer and how they may leave neg feedback with out making contact.



why not maker s strike system for sellers and remove feedback altogether, that way if buyers want they can select to not see lisitngs from sellers whom have X amount of strikes.

I might just add as well, when i signed up with eBay I was under the impression that i had just as much right to leave negative feedback for the buyer as they were for me, and that is what i agree to when i signed up with eBay, they still have not fixed it in there How feedback works section.





How Feedback works
Every eBay member has a Feedback Profile, which includes basic information about the member and the Feedback that their trading partners have left for them. Learning to trust a member has a lot to do with what their past buyers or sellers have to say.

For each transaction, buyers and sellers can rate each other by leaving Feedback. Each Feedback consists of a positive, negative, or neutral rating, and a short comment.



maybe there is some thing in that.

You cannot make a verbal agreement then once some one agrees to that change it on them. Were is the evidence they agree to the adjustment in a verbal agreement that was the different when signing up, if you take into consideration the fact they still have not adjusted this policy in their own how feedback works section, once you sign up you sign up to the rights and policies that were in place at the time, there is no possible way they can hold you accountable if you do not de register because they changed their mind on how feedback should work, otherwise they have breached the agreement not you.

if you read the pages and pages of small print, you will more than likely find a section that states that even though agreeing to their terms and conditions by joining up to ebay ( if you dont agree you dont join so there is a choice ) that it states that changes can be made to the agreement at any time, at which time if you dont agree or like the changes you can leave ebay.



And it is not just ebay, if you look at your phone company terms of agreement, your electricity terms of agreement, your banking terms of agreement, they all contain the contingency for the company to make changes to the terms of agreement at any time in the future.



This just happened to me with vodafone, i didnt get asked to resign a new set of terms of agreement, just got told if i dont agree with them i can leave at anytime i like.



All big companies change their terms of agreement on their customers, paypal seem to have been sending me quite a few emails lately telling me of the changes they have made to our terms of agreement contract.

But i do think that we are talking to teddie the wrong way, instead of telling he is wrong and he wont win.



Now i think we should tell him he could win, and for him to consult appropriate legal advice and take on ebay.
