Hi everyone,
basically I am the buyer for my problem, I purchased a ~$500 item (graphics card to be exact) and unfortunately my item was safe dropped as I had left my residence since the tracking didnt show out for delivery, however suddenly the next morning the tracking has 2 entries, one was out for delivery and the other delivered...
Unfortunately when I contacted the seller, they immediately attempted to cover their own back-side and started accusing me of being a scammer, swearing at me violently and lashed out at me. I have already reqested for Auspost to open an investigation, however they said there was not really anything they could or would do, as it wasnt their responsibility to cover loss since there was no SOD and/or insurance purchased by the sender.
Is there anything I can do? as paypal says that I cannot win this case since the seller has the tracking and some sort of supporting document.
I also have a thread on a different site, but unfortunately have not been able to get much information from it

Registered Post is NOT available for parcels.....you said it yourself, the parcel equivalent is Signature on Delivery and can have Insurance added.
Registered Post is only for use on letters now. If a seller tries to pass off a Registered Post parcel for paypal protection then I would definitely query it with paypal.
My only experience of courier deliveries was with a couple of FedEx parcels from the USA...they were fully trackable all the way and the delivery address was on the tracking site once they arrived in Australia.
I rarely get parcels delivered by courier, purely a personal choice, and the few that I have had I have never bothered to track...I just wait for them to arrive.
But I do know that any courier company can and will tell you where the item was delivered and who signed for it if there is a delivery query lodged or if it was returned to the base or (in the case of AaE, StarTrack or AP's own couriers) if it was left at the local Post Office.
As for what proof a seller needs to activate paypal seller protection....there are alternatives to Registered Post...there has to be as there is no longer Registered Parcel Post. But they all hinge on the seller being able to present proof of lodgment to the buyer's address, not just a suburb or postcode. I believe Click and Send is the most cost effective method for sellers at the moment.

Firstly: you are posting on an open forum where everybody/anybody can comment. I do admit that my post was a bit impulsive: the whole discussion seems to be pretty one-sided and I thought it could benefit from certain clarifications and another point of view. My post was not strictly "directed at you", too much hassle to split into individual replies. If you find my post offensive or inappropriate in any way there is a link to report it.
Secondly: I made an assumption in my initial post simply because it did not occur to me that a $500 item could have been posted as a standard parcel. PLEASE, PLEASE tell me that at least registered post (or signature on delivery as it is called now) option has been requested and paid for. As most individual sellers will not have a courier account that is pretty much the safest postage option.
Please do not get me wrong: I have been in your situation as a buyer and I deeply sympathize with you. At the same time having almost 10 years experience of selling on Ebay I realize that sometimes things may be bit more complex than they appear.

As I said before I did in fact request them, however the seller wasnt willing to comply, unfortunately I did not realize that the driver would simply leave my item at the front of my house, as usually when I use the prepaid satchels they are automatically taken to the nearest PO if the there is no one at the residence, however unfortunately the seller didnt even bother using the postage method that they had on the ebay listing and used some other service (presumably to save money).
Now I know that even the prepaid satchels can be safe dropped, however my driver never does that (no idea why), I know this because I have had quite a lot of deliveries this past month and I made sure that the delivery method used was the prepaid satchel, whether it be standard or express, not a single one got 'safe dropped' even when there was no SOD, value declaration or anything.
I realize that some may consider it a coincidnce, however I would like to think that it isnt after having the same experience for about 12 or so deliveries (give or take 2 where I might have been at my residence to accept it)

Elisabeth, I have no idea who you are replying to but if it is to me then I can only say that I have no problem with most of your post and have no intention of reporting anything.
However, it was necessary to correct the information you gave about Registered Post....it is a posting offence to post incorrect information on the boards and it is very counter productive to insist that there is a postal service that in fact does not exist any more.

I believe Elisabeths reply was in regards to my previous post (message #27)

Bad news for me, according to paypal the tracking number is fine and they dont need a lodgement recipt to declare the case in their favour, according to them >15km is acceptable. So is there anything I can do? As auspost isnt willing to do anything anymore, as according to them, they have done their part and it was the sellers responsability to ensure that either the items value was declared, SOD was purchased or at least a note should have been left saying DO NOT SAFE DROP....

Ring PayPal, and tell them that you did not get your item.
Apart from that, I'd try the Postal Ombudsman, and after that, your only option really seems to be the legals.

Paypal should look at their own policies. Seller has to prove lodgement (but a tracking event provides that) AND proof that it was posted to the correct address. Within 15km does not cut it, as they well know. They are trying it on. Ring them, insist on talking to a supervisor, advise said supervisor, politely, that unless you are refunded you will be taking the matter to the Financial Ombudsman Service. That should get the correct response, but if it doesn't contact the FOS.

I see, but I dont know why I always get these indian (not being racist, just from past experience) ones that dont even listen to me, they just go on and on about the same thing, how there is a tracking number and that it isnt far that the seller loses the funds... apparently it is fair if I lose mine.
Anyways I will give them another call, hopefully I get someone who will actually listen...

I just got off the phone with paypal and now they are saying that the seller has apparently provided a lodgement recipt that paypal cannot provide to me.... Does this mean that there is now no longer anything I can do? Would the FOS be able to do anything for me? As I am happy to go and file a police report or get a stat dec...
