JUST HAD A SITUATION WHERE I SOLD AN ITEM ON EBAY WHICH WAS PAYED VIA PAYPAL
PURCHASER WANTED A 50% DISCOUNT ON THE ITEM AS HE SAID HE COULDNT AFFORD IT(ITEM WAS A BUY IT NOW ONLY LISTING)
WE NEVER OFFERED A DISCOUNT.HE PURCHASED THE ITEM THEN UPON RECEIVING IT SAID IT WAS FAULTY
WE ASKED FOR THE ITEM TO BE RETURNED SO WE CAN INSPECT IT AND IF THERE WAS AN DAMAGE DURING TRANSPORT ETC WE WOULD REFUND ,HE REFUSED AND OPENED A PAYPAL DISPUTE REQUESTING 1/2 THE MONEY BE RETURNED
WE DECLINED AS WE KNEW THE ITEM WAS GOOD,WHY WOULD YOU WANT A FAULTY ITEM ?
WE RECEIVED THE ITEM BACK(WAS A SET OF INSTRUMENT GUAGES ) BUT HE HAD STOLEN THE GUAGES AND SENT ONLY THE HOUSING BACK
WE IMMEDIATELY INFORMED PAYPAL WHO SAID TO GET A PHOTO AND A LETTER FROM A REGISTERED WORKSHOP STATING CONDITION OF RETURNED ITEM WHICH WE DID AND SENT THEM TO PAYPAL(THEY REPLIED THEY HAD RECIEVED THE INFO
TODAY PAYPAL SENT AN EMAIL CASE CLOSED IN FAVOUR OF BUYER(WHO STOLE THE GUAGES)
THEY SAID WE CAN FILE A DISPUTE IF ITEM WAS NOT RETURNED AS DESCRIBED....THEY ALREADY HAVE THIS INFO ...DONT THEY READ IT .....WHY REFUND THE PURCHASER AND THEN ASK IF ITEM NOT RETURNED AS SENT FILE A CLAIM ESPECIA;LLY WHEN I HAVE CALLED AND EMAILED REGARDING THE CLAIM PREVIOUSLY
THIS IS THE REASON I HATE PAYMENT GOING THRU PAYPAL,IT ALLOWS LOW LIFE TO MAKE FALSE CLAIMS / STAEL ITEMS AND GET AWAY WITH IT
ACTIONS LIKE THIS WILL FORCE PEOPLE TO HAVE LOCAL PICK UP ONLY ON THEIR ITEM SO AS NOT TO HAVE TO DEAL; WITH PAYPAL WHO ARE GEARED ONLY TOWARD THE BUYER
I HOPE THIS DOESNT HAPPEN TO ANYONE ELSE
WILL LET YOU KNOW WHAT THE OUTCOME IS BY 2 JUNE 2013

i did take on board you earlier comment and advised them that my next port of call if i didnt get my funds would be to the ombudsman,and they were well aware of his office ,just prior to sending my stat declaration to them

I hope nobody would expect Paypal to take the word of one party or the other, like most other situations involving a dispute the side with the best evidence wins.
Scamming buyers and sellers are probably pretty evenly matched in number so how else would you expect Paypal to resolve a case like this other than requiring a police report and a stat dec. from one side or the other.

Well they did take the buyers word as truth even though the seller supplied pictures of the empty cases as per the OP with verification from a third party ( a registered workshop ) as paypal asked

... PAYPAL still took the word of the buyer and took the funds from the sellers account and repaid the buyer even though the seller had supplied supplementary 3rd party information.
In fact paypals customer ie. the seller has had to make a second complaint and waste more time.
In my opinion the outcome is a poor one for paypals customer ie. the seller.
Even though the seller has now been refunded I would still complain to the ombudsman re paypals obfuscated policies and poor customer service.
The whole process has cost the seller time. A less driven seller may have given up ( a course of action I think paypal banks on some sellers doing)
If affected sellers do not complain then do not expect paypals actions to be modified

so my point is the buyer offered.... a tracking number as evidence.
The seller offered third party verification that the item was not returned in the same condition.
Paypal sided with.... a tracking number and against the seller (their customer).
The customer complained......again...... and paypal asked their customer for more
supplementary information ie a police report. After receiving the police report number Payapl still refused to refund their customer and produced another hoop ie asked for a statutory declaration

"i had to go and report it to the police which i did and got a card off the officer with his name ,event number etc and sent it to paypal
paypal would(nt)?(sic) accept it as they said they needed it on a police letterhead with the a statement of the events,his name,badge number ,etc...
i informed them that the police offer said they dont provide that and for them to call him
i told paypal to call the police station and they said they wouldnt
they said i now have to supply a stat decleration which i did "

So the buyer supplied a tracking number and paypals customer ie. the party that pays the fees the seller was made to jump through hoops like a trained animal but thankfully persistance won out......

Paypal allways take the word of the buyer..they should just have a "I changed my mind " button for buyers for a automatic refund instead of wasting time time with "not as described" cases..there is no point in selecting "returns not accepted" so why have that choice??
I had 5 pictures on my auction which clearly showed the item condition yet buyers word was taken..Funny thing was they had bought 1 item in 12 months I was buying 30 a month..
I stopped selling and I only buy prob 1 a week now..

this is why I hate paypal as well. Sadly bad buyers know how to steal using paypal. I have asked a simple question and emailed paypal after 6 emails I finally got a human. Their service is the same as ebay

and to add insult to injury he left negative feedback on 8th may 2013 to justify he is making a legit claim
and yes paypal appears to just give the purchaser their funds without any proof yet seller has to fight for his funds

That really sums up where paypal has evolved to now.It would be nice if paypal employees
entertained some common sense when making dispute decisions but seems they just refer to the handbook which I gather says side with buyer..

I have had people ask for extreme discounts and I reply with no to their request and then block them.

You can almost certainly have that neg removed by lodging a Notice of Claim of Defamation.
