I have bought 2 kids smart watches, a blue and a pink, for a total of AUD$121.42 after discount from seller REMOVED on ebay on the 27th of November, 2020. Upon arrival, the pink watch's battery does not hold its charge as compared to the blue watch. Within 6 to 7 hours, the pink watch would go from 100% to 0%. The blue watch would last a day and a half on average. I did reset the watch a few times, but it did not help. The seller did refund $20 as it was still usable. After 2 months, my blue watch totally cannot work. It does not switch on or charge anymore. The pink one, which seller partially refunded $20, only hold a charge for a few hours daily; from 100% to 0% in 2 to 3 hours just sitting on my desk. These watches are meant for tracking kids with GPS in the event that they are lost. I wanted to return BOTH for a refund or replacement. Before buying, the ebay website stated that there is a 1 year warranty on the watches. But the seller decline the ebay return request, stopped responding, and has since taken down the ebay website. I have even sent the seller a video showing the problem. As it is more than 30 days, ebay refused to help as well.

Please read this reply to a previous thread in which I address the warranty issue.
As it's now too late to make a claim through eBay, you must go through PayPal.
PayPal Buyer Protection - Open a Dispute
You can still open a claim in PayPal using PayPal Buyer Protection (you have up to 180 days to open a dispute, and once you've opened the dispute, you must escalate the dispute to a claim NO LATER than 20 days after opening the dispute).
Do not - absolutely do NOT - close the dispute without getting your full refund. The seller could promise a refund, tell you that you need to close the dispute in order to get the refund, and that would be that - you'd be stuck from that moment onwards, because once closed a PayPal dispute can't be re-opened.
(Sellers promising refunds and trying to manipulate buyers into closing disputes is a well-known tactic.)

Glad you got it sorted.
If you actually read the replies you got from members here you would have realised that it is only permissable to open 1 dispute at a time. Ebay always first then if that fails Paypal. Your comments to members about their wealth ot lack of are totally uncalled for.
You were given info you required but you decided responders here had no idea.

If you paid by Paypal, you have 6 months (180 days) from purchase to open a case for Item Not as Described, to get a refund.
Do not close the case, no matter what the seller says, until you are refunded.. They will say they can't refund until you close the case. This is not true.
You cannot reopen it.

There is zero warranty, as with any item , for there to be a warranty the seller needs to be authorised to sell / re-sell the product
This seller is not
PLUS that seller is in Hong Kong
And their feedback is less than wonderful

Yup about the 0 warranty; learned it the hard way unfortunately. ACCC did say that regardless, we have the right to the refund. But I am not holding my breath for it. As you have mentioned, the seller is in HK.

Naming and shaming might make you feel like you have achieved some form of revenge, but it will be removed and acheives absolutely nothing.
Just like nothing the ACCC says is applicable to a seller from Hong Kong.

You really think it is about revenge? Seriously? What it does is give me more information as to what I can do from all the wonderful replies here. So I wouldn't say it achieve nothing. Also, if everyone were to keep quiet about such things, then the seller will continue to do what he did. People should be made aware. At least they would not fall into this seller's trap.

I did open a Paypal case as well. Paypal contacted me and said they could not do anything.

I know I cannot name the seller due to policies in place. But I would say, if it is allowed, that the seller is from Hong Kong and has a similar name to yum*****ser.
